Тестмейт User Agreement

1. Service provider

Товарищество с ограниченной ответственностью "Цедра Груп", БИН 230140044071 is the provider and operator of the Тестмейт application. Sayazhan Onglassyn is the authorized representative of Cedra Group LLP solely for distribution of the application through the App Store and does not replace the provider under this agreement.

2. Key terms

“Тестмейт” or the “Service” means the mobile application, its functions, and the study materials available in it. “User” means an individual who opens or uses the Service. “Account” means the profile created after signing in with Apple. “User Content” means a nickname, feedback, or other material voluntarily submitted through an available feature.

3. Age and eligibility

The user confirms that they may enter into this agreement under applicable law. A user under 18 represents that they obtained permission from a parent or other legal guardian before using the Service; Cedra Group LLP does not verify the existence or validity of that permission.

4. Acceptance

Proceeding from the sign-in screen to use Тестмейт constitutes full acceptance of this agreement to the extent that this method of acceptance is permitted by law. A user who does not agree must not continue signing in or using the Service.

5. Account and sign-in

Sign in with Apple is the authentication method. The user must control access to their device and Apple account, report suspected unauthorized access, and provide accurate information when the Service asks for it.

6. Service features

Тестмейт provides self-study tools including educational questions, explanations, practice activities, and progress statistics. The composition, sequence, and availability of free and paid features may change after notice to the user.

7. Paid features

The price, trial period, duration, automatic renewal, included features, and other specifics of a paid offer are governed by the Apple offer displayed before purchase and the Тестмейт Subscription Terms. Purchases and subscription management take place through the user’s Apple account.

8. Acceptable use

A user may study the materials, maintain personal progress, choose a nickname, and submit feedback. When using the Service, a user must not:

• impersonate another person or mislead others about identity or authority;
• abuse, harass, or threaten anyone, or publish unlawful, harmful, or discriminatory material;
• collect data automatically, scrape the Service, or copy its content in bulk;
• decompile, reverse engineer, or attempt to obtain source code except where mandatory law expressly permits it;
• bypass technical restrictions, access limits, payment mechanisms, or safeguards;
• compromise security, interfere with operation, introduce malicious code, or obtain unauthorized access;
• infringe copyright, trademark, privacy, data protection, or other rights of a third party.

9. Nicknames and feedback

The user retains rights in their nickname and feedback but grants Cedra Group LLP a non-exclusive, royalty-free right to store, display, and process them as needed to operate, support, and improve the Service. The user is responsible for the legality of submitted content; the company may hide or remove material that violates this agreement or the law.

10. Intellectual property

Тестмейт, its software, design, question database, explanations, graphics, and other materials belong to Cedra Group LLP or are used under lawful authority. The user receives a limited, revocable, non-exclusive, non-transferable license solely for personal, non-commercial study; sale, publication, distribution, or creation of derivative materials without written permission is prohibited.

11. Educational limitations

Тестмейт is an independent study service and is not affiliated with, endorsed by, or operated by any official examination center, government authority, or educational institution. Materials may be inaccurate, incomplete, or outdated and do not replace official curricula, examination rules, or professional advice.

12. Access restrictions

Cedra Group LLP may temporarily restrict or terminate access for a breach of this agreement, a security threat, fraud, a binding legal requirement, or the need to protect users and the Service. Where reasonable and lawful, the user will be told the reason and any available appeal route.

13. Ending use and deletion

A user may stop using the Service at any time and request account deletion through the available function or the unified contact details. Deleting the application does not cancel an active Apple subscription; it must be cancelled separately in Apple account settings. Mandatory retention periods continue to apply.

14. Availability and feature changes

The Service is provided subject to technical availability. Updates, maintenance, interruptions, and feature changes may occur; Cedra Group LLP takes reasonable measures to restore operation but does not promise uninterrupted or error-free access. Where circumstances beyond the company’s reasonable control affect performance, the affected obligations are suspended only to the necessary extent and for the duration of those circumstances; the company will take reasonable measures to limit the effects and resume performance.

15. Liability

Each party is responsible for breach of its obligations within the limits of applicable law. To the maximum extent permitted by law, Cedra Group LLP is not liable for indirect loss, lost profit, decisions based solely on study content, or failures of third-party platforms. Nothing in this agreement excludes liability that cannot lawfully be limited.

16. Complaints

A complaint may be sent to [email protected] or to: Kazakhstan, Almaty city, Bostandyk district, Radostovets Street, building 189, apartment 37, postal code 050060. Include a reply contact, a description of the issue, and relevant details. Cedra Group LLP will provide a written response within 10 calendar days after receipt. If full resolution requires additional review, that response will describe the actions taken and the next steps; this does not change the deadline for providing the written response. An unresolved dispute may be submitted to consumer-protection bodies or competent courts.

17. Governing law

This agreement is governed by the law of the Republic of Kazakhstan. This choice does not remove any mandatory rights or remedies granted by the law of the user’s country of habitual residence where those rights cannot be waived by agreement.

18. Changes to these terms

Cedra Group LLP may update this agreement when laws, features, or business processes change. The company will give 30 calendar days’ notice of material changes where practicable; a shorter period may apply for an urgent legal requirement, security need, or prevention of abuse.
